The Prosecutor’s Office for the Protection of Women (FEP-MUJER) filed a prosecutor’s complaint against the deputy of the Libertad y Refundación party Bartolo Fuentes for assuming he was responsible for committing crimes to the detriment of a woman.
The deputy for the department of Yoro Bartolo Antonio Fuentes is accused of the alleged crimes of cruel, inhuman or degrading treatment by a public official and aggravated violence against women.
According to the victim’s statement, the events occurred on January 9, 2022, when several deputies were in a meeting in the National Congress to agree on the positions of the Yoro departmental government.
In that meeting, the deputy Bartolo Antonio Fuentes verbally assaulted the victim, stating “that she was a liar, old, corrupt” among other insults and violently began to hit the table and addressed the victim with the purpose of hitting her in the face. Failing to do so, he continued to insult her and verbally assault her.
For this reason, the offended party filed a complaint with the Public Prosecutor’s Office, for which the prosecutor’s office filed a prosecutor’s request based on articles 217 and 209 of the Penal Code, also taking refuge in what refers to the International Covenant on Civil and Political Rights (ICCPR), the Convention on the Elimination of all forms of Discrimination against Women (CEDAW), the Inter-American Convention to Prevent, Punish and Eradicate Violence Against Women “Convention of Belem Do Para” and the United Nations Declaration on the Elimination of Violence against women (1993).
During the investigative procedures of the FEP-MUJER, psychological and psychiatric evaluations were carried out on the victim, establishing in the forensic opinion that the evaluated person presents moral damage reflected by the discomfort she experiences when seeing her honor and reputation discredited by the action of a third party Likewise, the psychiatric report states that the offended person presents moderate depression as a diagnosis, associated with moral issues.
Due to these facts, the FEP-MUJER presented the prosecutor’s request and requests that a natural judge be appointed, the accused be summoned, a psychological evaluation of the accused be authorized, a statement be received from the victim with advance evidence formalities and through the Gessell Chamber, in addition that a public defender be appointed to represent the accused during said proceeding.
