Shoshone County prosecutors in Idaho say they will not seek the death penalty against a 31-year-old father accused of shooting his neighbor’s family after a teen in the household allegedly exposed himself to his daughters.
Majorion Kaylor of Kellogg is facing four counts of first-degree murder and a burglary charge after police said he told them he “snapped” on Father’s Day in an escalating argument with the family next door.
“In the event that the defendant in the above case is found guilty, either by an admission of guilt as charged with first-degree murder, by a finding of guilt, or by a decision of the trial court without jury, of (counts 1 through 4) of the complaint filed in the above case, the State of Idaho shall not seek a death sentence, but reserves the right to seek any other punishment permitted under Idaho law, other than death, Shoshone County Prosecuting Attorney Benjamin Allen wrote in a lawsuit.
Police say trouble had been brewing between Kaylor and his newly moved-in neighbors since two weeks ago, when Devin Smith, 18, allegedly exposed himself to Kaylor’s wife and daughters through a window.

Violence erupted on Father’s Day when Kaylor reportedly shot Kenna Guardipee, 41, and her father, Kenneth, 65, on their back porch, each with a .45-caliber gunshot wound to the right temple.
They were Smith’s mother and grandfather.
Detectives found Smith dead on his knees in a bedroom with gunshot wounds to the head.

Between the kitchen and living room, they also found a 16-year-old boy, whose name was redacted from the court documents because he was a minor, with a straight gunshot wound to his right temple. His name has been released separately.

“KAYLOR stated that he was suspicious and concerned for his children as one of the victims (Devin Smith) acted suspiciously, kept an eye on his children and showed himself naked in front of his children,” reads an affidavit obtained by Fox News Digital. “KAYLOR called Devin Smith a pedophile.”
He confronted the Guardipees about his concerns about Smith, and according to court documents, he felt they were not taking the situation seriously.

“KAYLOR said he ‘got it,’ ‘lost it,’ and ‘did something about it,'” the affidavit reads. “KAYLOR then indicated that he wanted a lawyer, and the interview was over.”
According to court documents, the Guardipees had recently moved in next door to the Kaylors.

Subsequently, on June 13, Smith allegedly exposed himself to Kaylie Kaylor, Majorjon’s wife, and their daughters.
On Father’s Day, an argument broke out between the Guardipees and Kaylors, the affidavit says.
Kaylie Kaylor “seemed concerned that there would be no repercussions” for police Smith or his grandparents. Then violence broke out, according to court documents.

She and her husband reportedly discussed what to do and shared a photo of Gary Plauche, who shot the suspect accused of kidnapping and raping his child in 1984.
Kaylor could face life without parole if convicted. He was held without bail and is due back in court on July 3.
Supporters of the Guardipee family have launched a GoFundMe campaign to help cover funeral expenses.
