Former Vice President Mike Pence called former President Donald Trump’s actions during the Jan. 6 protest at the US Capitol “reckless” but said he is “not sure” his former boss committed any crimes.

“I’ve said many times that the president’s words that day were reckless. I had no right to overturn the election. But while his words were reckless, from what I know, I’m still not convinced they were criminal. I obviously didn’t attend every meeting,” Pence said on CNN’s “State of the Union.”

Last week, Trump announced that he had received a letter from special counsel Jack Smith saying he was the target of a grand jury investigation on Jan. 6. The former president said he expects both an arrest and charges.

Pence, who is running for president in the 2024 election, said he hopes “it doesn’t come” to an indictment against Trump regarding the 2020 election and Jan. 6, while noting that he believes he personally handled the day well.

“I know I did my duty that day,” Pence told CNN’s Dana Bash.

“In one town hall after another, all over New Hampshire, I heard a deep concern… about the unequal treatment of the law, and I think another indictment of the former president will only add to that feeling among the American people,” Pence said. “I’d rather these issues and the judgment of his conduct be left to the American people on January 6 in the upcoming primaries, and I’ll leave it at that.”

Pence added that he “didn’t know what (Trump’s) intention was” on January 6, 2021, summarizing what he saw of the former president as “reckless.”

“I believe history will hold him accountable. I believe the Republican primary voters know we need new leadership in this party. I know some pundits and pollsters think things are different there,” Pence continued.

If indicted on Jan. 6, it would be Trump’s third indictment this year.

The Manhattan District Attorney’s Office indicted Trump in March over payments made to adult film actress Stormy Daniels ahead of the 2016 election. Trump pleaded not guilty in that case and has denied sleeping with Daniels or falsifying business records to conceal the payment.

Trump was again indicted in June on charges of willful withholding of national defense information, conspiracy to obstruct justice and false statements. Trump pleaded not guilty and dismissed the allegations as a “witch hunt”.

Trump denounced the Justice Department after receiving a letter revealing he was the target of a grand jury investigation into his January 6 actions, calling the case another “witch hunt.”
