The primary article of impeachment towards Division of Homeland Safety Secretary Alejandro Mayorkas was deemed unconstitutional by the Senate in a party-line vote on Wednesday.
The primary of two articles of impeachment alleged that Mayorkas, in his capability as DHS secretary, was responsible of the “deliberate and systematic refusal to adjust to the regulation” concerning the southern border.

Majority Chief Chuck Schumer, D-N.Y., proposed a degree of order declaring the article unconstitutional, which the vast majority of senators agreed to after a number of failed motions by Republicans.
The article was deemed unconstitutional on a 51-48 vote, with Sen. Lisa Murkowski, R-Alaska, current.
