The impending end of Title 42 has put Border Guard officials and Republican border hawks on edge as tens of thousands of migrants are expected to pour across the border and overwhelm law enforcement. Title 42 has been used by both the Trump and Biden administrations since 2020 to rapidly deport hundreds of thousands of migrants due to the COVID-19 pandemic. In March, nearly half of all migrant encounters ended in a Title 42 eviction. The order ends on May 11, along with the COVID-19 national emergency.
Customs and border security facilities already have overcapacity in multiple industries, according to CBP sources who spoke to Fox News Digital. The city of El Paso, Texas, has already seen thousands of migrants camping on its sidewalks.

According to Border Patrol, officials have made 26,000 arrests and seen more than 7,000 “escaping” in just 72 hours. Those numbers are staggering, and the White House declined to say how many more will follow.
The mostly single migrants are expected to be encouraged by the belief that they have a better chance of being allowed into the US once the order expires. The Biden administration has said this is misinformation and has warned that it is toughening penalties for illegal entry and urging migrants to use extensive legal avenues instead. The prospect of massive domestic releases of those who have entered the US illegally after crossing multiple countries is likely to undermine that narrative.
“I can’t get into hypotheses about the numbers and what they would be or will be,” said Jean-Pierre. “That’s not something I’m going to do here. What I can say is we obviously knew we knew from the court that Title 42 was going to be lifted on Thursday, that’s something we’ve obviously been very aware of since earlier this years. We have put in place plans and processes to deal with this moment.”

She announced that Homeland Security Secretary Alejandro Mayorkas will join her at the daily press briefing on Thursday to discuss the administration’s handling of the incoming migrants.
“We have a multi-agency process. We think we have a robust process for dealing with what’s going to happen after Title 42 is lifted,” said Jean-Pierre. “Again, we are using the tools available to us because Congress refuses to do its job when it comes to the border. Again, a system that has been broken for decades.”
