The administration of Indian Prime Minister Narendra Modi made a historic decision in August 2019, revoking the special status granted to Indian-occupied Kashmir under Article 370. The recent decision by India’s Supreme Court to sustain this measure sparked tremendous outrage both domestically and globally. This judgment, seen as a defeat for Kashmiri autonomy, has enormous regional repercussions, aggravating existing tensions and raising concerns about the region’s already precarious human rights status.

Kashmiri Autonomy Under Siege

The repeal of Article 370 is a big setback for Kashmiri political groupings that have long advocated for independence and autonomy. The region, which is claimed by both India and Pakistan, has been a source of continual strife, resulting in three of the four wars between the nuclear-armed neighbors since their independence from Britain in 1947. The removal of Article 370 heightened tensions, with many Kashmiris viewing it as an annexation intended to change the demographic makeup of the territory. Fears extend beyond the majority Muslim population to minority Buddhist populations, which applauded the move at first but are now afraid about losing land and jobs. The overwhelming rejection of the Supreme Court’s ruling by Kashmir’s diverse political factions, including the All Parties Hurriyat Conference, reveals a profound sense of betrayal. Leaders stress their intention to fight for the right to self-determination guaranteed by UN Security Council resolutions. The situation underscores the region’s humanitarian and political crises, which has been aggravated by India’s military involvement and the enforcement of harsh laws that have resulted in extra-judicial killings, detentions, sieges, and other human rights violations.

Policy Implications and Ambiguities

The Supreme Court’s ruling has far-reaching consequences, not only for the region but also for India’s democratic framework. The court’s refusal to consider whether parliament may turn a state into a union territory casts doubt on Jammu and Kashmir’s future political situation. The postponing of elections until 2024 slows the democratic process even more, calling into question the fundamentals of representative administration.

Global Concerns on Human Rights in Kashmir

The international community’s response, or lack thereof, to the deteriorating human rights situation in Indian-occupied Kashmir raises alarms post the Indian Supreme Court decision. The global silence on the suppression of political, social, cultural, and religious rights of the Kashmiri people has allowed the situation to worsen. The Indian Supreme Court’s assertion that not every decision by the Union government can be challenged also raises questions about the democratic framework and the role of citizens in holding the government accountable. One significant incident, however, was in 2019 when the UN, through its then-High Commissioner for Human Rights Michelle Bachelet, protested the decision, highlighting the need of respecting Kashmiris’ human rights. Bachelet urged both India and Pakistan to hold constructive talks to address the concerns generated by the revocation, highlighting the necessity of taking the wishes of the Kashmiri people into account in any decision-making process. As a result of such incidents, the international community has appealed for caution and a peaceful resolution to the long-running Kashmir conflict, emphasizing the decision’s broader consequences for regional stability and the peace process.

A Plea for International Intervention

Prominent voices, including jailed leader Shabbir Ahmed Shah, have asked the international community to address the deteriorating human rights situation in Indian-occupied Kashmir. Shah emphasized the importance of settling the Kashmir dispute as soon as possible and amicably, encouraging the international community to play a critical role in resolving the matter peacefully. The call for a ‘truth and reconciliation committee’ to investigate human rights breaches emphasizes the crucial importance of accountability and justice.

As the world observes the aftermath of the Supreme Court’s decision, there is a collective responsibility to advocate for human rights and democratic norms in the region. The international community must leverage its influence to ensure that the genuine aspirations of the Kashmiri people for self-determination and a just political future are not thwarted. The Supreme Court’s verdict has left many questions unanswered, and it is imperative for the global community to address these concerns, ensuring a peaceful and equitable resolution to the longstanding Kashmir dispute.
