Idaho murder suspect Bryan Kohberger wants more time for that

Suspicious murders in Idaho Bryan Kohberger’s lawyers are asking for more time to give the state an alibi for his defense.

Kohberger, 28, is on trial for the November 13, 2022 murder of four University of Idaho students: roommates Madison Mogen, 21; Kaylee Goncalves, 21; and Xana Kernodle, 20; as well as Kernodle’s friend, 20-year-old Ethan Chapin – in their off-campus home.

The request comes after Idaho prosecutors filed a motion on May 26 demanding that Kohberger’s alibi be terminated, which the Idaho Supreme Court defines as evidence showing “that the defendant was not present at the time and the place of the commission of the alleged crime for which the accused is here tried.”

Kohberger’s public defender Anne Taylor said in a filing filed Friday that prosecutors have so far released “51 terabytes of information, including thousands of pages of discovery, thousands of photographs, hundreds of hours of recordings, many gigabytes of electronic phone records and data from social media have been released.”

Discovery — or the process of sharing information between prosecutors and the defense — in Kohberger’s case is “major and ongoing,” Taylor continued.

The suspect’s defense team will “continue both to navigate the discovery disclosed by the state and to investigate the charges against Mr. Kohberger,” she said, adding that it is now premature to put an alibi on because wading through the extensive information that is part of the case is incomplete.”

Prosecutors allege that Kohberger, a Ph.D. student at nearby Washington State University studying criminology drove to the victim’s home in the early morning hours of Nov. 13, just steps from the campus of the University of Idaho and Chapin’s fraternity.

He then reportedly entered the house and stabbed the four young victims multiple times as they lay in bed on the second and third floors of the house, killing them and apparently sparing two other roommates on the first floor.

Investigators say Kohberger’s vehicle took an indirect route to his apartment in Pullman, Washington that morning. His car was spotted again near the crime scene later that day, according to an affidavit.

Authorities arrested Kohberger on December 30, 2022, at his family’s home in Pennsylvania. The suspect has pleaded four counts of first-degree murder and one count of burglary.

His trial date was set for early October, but could be postponed if the defense waived Kohberger’s right to a speedy trial.
