India’s Secular Dilemma: Protecting Minority Rights in a Complex Landscape

The greatest democracy, India, has long been praised for its diverse culture and diverse mindset. India is a secular state, and its Constitution ensures that all of its inhabitants, no matter what their religion or ethnicity, have equal rights and protections. Though India’s Constitution forbids discrimination on the basis of religion, the country’s dedication to secularism has raised concerns in recent years regarding the country’s protection of minority rights. Notwithstanding the constitutional protections, worries regarding India’s infringement on minority rights have grown.

Religious violence has occurred in India, frequently disproportionately affecting minority communities. Minorities now feel more vulnerable and afraid as a result of incidents like mob violence and community riots. Minority communities seem to be disproportionately affected by several laws and policies of the government. For instance, discrimination against Muslim minority has been a source of concern with the contentious Citizenship Amendment Act (CAA).The rise in hate speech and religious intolerance has caused tensions within communities and the marginalization of minority groups.

Concerns on the situation in India have been voiced by the international community. Numerous international organizations and prominent figures have issued declarations emphasizing the necessity of safeguarding the rights of minorities and maintaining the values of secularism.

The United Nations has consistently urged India to protect minority rights. In 2019, the United Nations High Commissioner for Human Rights, Michelle Bachelet, voiced concern over the CAA and its potential to discriminate against Muslims and other minorities.

Amnesty International has documented violent events against Indian minorities and demanded responsibility and redress. Concerns regarding the freedom of expression and peaceful assembly have been brought to light by the group.
