JOHOR BAHRU – The Supreme Court in Johor Bahru has rejected a caning sentence for a youth who pleaded guilty to setting a dog on fire.

Supreme Court Judge Abu Bakar Katar made the decision after reviewing the sentence handed down to 18-year-old Braden Yap by the Sessions Court on April 19.

Yap was previously sentenced to seven light caning charges in open court on May 21 and a one-year bond of good behavior with a bond of RM10,000 (S$3,000) by a Judge of Sessions Court.

Lawyer GK Sritharan, representing Yap, said the Supreme Court judge called the prosecution and defense on Sunday to hear the sentence changes.

He said the Supreme Court judge has revoked the light caning sentence so that Yap only has to serve the 12-month good behavior bail.

“The decision was made because according to Article 293 of the Code of Criminal Procedure (CPC), two sentences cannot be imposed,” Sritharan said.

Section 293(1)(c) of the CPC allows the court to order a male offender to be flogged with no more than seven strokes of the cane within the courthouse and in the presence of the parent and guardian.

On April 12, Yap pleaded guilty to a charge of causing excruciating pain to a brown female dog by beating and setting her on fire.
