An Arizona man was charged with murder after allegedly shooting and killing a friend on New York’s Long Island Railroad in February 2022.
Suffolk County District Attorney Raymond A. Tierney announced the indictment of 20-year-old Nicholas D’Agostino, who is accused of killing 20-year-old Yusef Staine in an execution-style shooting.
D’Agostino is charged with manslaughter and second-degree criminal possession of a weapon.
Investigators claim that D’Agostino traveled from Arizona on February 13, 2022 and arrived in Wyandanch to visit Staine. Two days later, the two men, along with two others, took a train to New York City from Wyandanch.

D’Agostino and Staine returned to Suffolk County in the early morning hours the next day, and Metropolitan Transit Authority (MTA) Police surveillance footage showed the two having missed their stop in Wyandanch.
Once the train stopped in Ronkonkoma, the two men got off the train and took the next train westbound, back to Wyandanch.
As he boarded the westbound train, the district attorney’s office said in a press release, D’Agostino walked up behind Staine and shot him once in the back of the head. Stain fell to the ground, the prosecutor said, before D’Agostino shot him again in the torso.

After the shooting, investigators learned that D’Agostino had fled the train station. The Suffolk County Police Department collected additional surveillance video that enabled the department to track D’Agostino’s movements leading up to, during, and after the shooting.

Investigators also used cell phone data to track D’Agostino’s movements.

After a year-long investigation, detectives from the Suffolk County Police Department arrested D’Agostino on May 18, 2023, in Yonkers, New York, and the next day he was arraigned in Suffolk County by Acting Supreme Court Justice Steven A. Pilewski.
Judge Pilewski ordered D’Agostino held without bail. If convicted, he faces up to 25 years to life on murder charges.

“The defendant allegedly executed someone who considered him a friend. This defendant thought he could get away with it because he wore a mask and then fled Suffolk County, but he was clearly wrong,” Tierney said. “Thanks to the tremendous investigative work of our Suffolk County prosecutors, detectives and police, we were able to establish the identity of the defendant and charge him with this brutal murder. Let’s be clear – if you want our citizens here in Suffolk harm, you may run, but you cannot hide, for we will continue to pursue you until you are held accountable for your crimes.”
