A federal appeals court rejected that on Wednesday Donald Trump‘s attempt to prevent former Vice President Mike Pence from testifying before a federal grand jury investigating the former president’s role in the January 6 riot and efforts to overturn the 2020 election.

The U.S. Circuit Court of Appeals in Washington declined to block Pence’s post-Trump subpoena appeal filed this month to block a lower court ruling to order Pence to testify. Trump’s trial came days later a Pence adviser said the former vice president would not appeal an assignment for his testimony.

Trump can still appeal to the Supreme Court, but has not indicated whether he will. A Trump spokesperson did not immediately respond to a request for comment Wednesday night.

Pence’s subpoena was issued by special counsel Jack Smith, who was appointed in November by Attorney General Merrick Garland to oversee the Justice Department’s investigation into Trump’s Jan. 6 role and his alleged mishandling of classified information. documents after his term of office.
