The Department of Justice (DOJ) took Texas to court Monday over the state’s decision to curb illegal immigration with a floating buoy border barrier on the Rio Grande.

The DOJ first announced their intention to file a lawsuit last week in a letter to Governor Greg Abbott. The lawsuit was filed Monday afternoon in federal court in the Western District of Texas.

In the lawsuit, the DOJ claimed that the barrier “impedes the navigable capacity of United States waters.” The department noted that Texas installed the barrier without federal government approval as to whether it was safe for the public and the environment.

“The actions of the State of Texas violate federal law, raise humanitarian concerns, pose serious risks to public safety and the environment, and may impair the ability of the federal government to perform its official duties,” the DOJ said earlier in the letter, according to the Houston Chronicle.
