The investigation into the death of the Brazilian model Emmily Rodrigues in Retiro added evidence that could be key to the strategy of the lawsuit. A syringe seized from the apartment of businessman Francisco Sáenz Valiente, prosecuted for manslaughter, in which there was ketamine. For the victim’s family lawyers, the model could have been injected with this drug before falling from the sixth floor. And for these hours, she is considering asking for a more serious accusation for the defendant.
Meanwhile, the judge in charge of the case declared herself incompetent, since one of the crimes charged is the supply of drugs, and turned the file over to federal jurisdiction.
The expert report was carried out by the Directorate of Criminalistics and Forensic Studies of the National Gendarmerie, which carried out a qualitative chemical analysis of psychotropic and narcotic drugs in a series of samples taken from different objects seized in the businessman’s Retirement department.
“The sample analyzed and identified as ‘M8J’ contains ketamine as an active ingredient,” says one of the conclusions of the report, referring to a colorless liquid that was found inside a 20-milliliter plastic syringe found in the apartment.
The same report rules out the presence of this and other drugs in the rest of the elements studied.

Ketamine was one of the substances that, along with MDMA (ecstasy), cocaine, marijuana and alcohol, toxicological studies had detected in the blood and urine of the Brazilian model.
The expert opinion has the signature not only of the official expert of the Gendarmerie, First Ensign Lorena Buyatti, but also of the experts on behalf of the complaint and the defense, Walter Gorbak and Ángel José Martín, respectively.
When describing the effects of this drug, the experts pointed out that ketamine “is a dissociative anesthetic that has hallucinogenic effects”, which “can induce a state of sedation, immobility and amnesia, in addition to relieving pain”.

In addition, it specifies that in its liquid form “it can be injected or mixed with drinks” and that it can also be used “to facilitate sexual assault.”
“With this new evidence, we are convinced that Emmily was injected with ketamine. You have to remember the audio of the second call to 911 where while asking for help, she is heard clearly saying the phrase ‘I was shot!'” The plaintiff lawyer, Ignacio Trimarco, was assigned to the Télam agency.
The plaintiff lawyer also reported that the syringe found was seized “in the same room where Emmily’s fuchsia top was found, which last week, with other tests, we found out had a bloodstain.”

Trimarco anticipated that he is already working to make a presentation in the case in which he will raise “a much more serious accusation for Sáenz Valiente” and there is even speculation that there is a request for “a new autopsy.”

After judge María Fabiana Galletti, in charge of the Buenos Aires Criminal Court 31, declared herself incompetent, the case was referred to the Federal Criminal and Correctional Appeals Chamber of the City of Buenos Aires, which must now draw a court of that jurisdiction.
Francisco Sáenz Valiente (52) is the main defendant in Emmily’s death.
It occurred after room VI of the City’s Criminal and Correctional Appeals Chamber confirmed the prosecution of Sáenz Valiente for the crime of “free supply of narcotics, in an ideal contest with the provision of a place for consumption, in a contest ideal with culpable homicide in real contest with illegitimate possession of a weapon for conditional civilian use”.
The confirmation of the prosecution was signed last Wednesday by the chambermaids Magdalena Laiño Donidz, Ricardo Matías Pinto and Ignacio Rodríguez Varela. This Monday, the defense of Sáenz Valiente -represented by the lawyers Gustavo Facundo Orazi and Rafael Cúneo Libarona- raised the incompetence of the ordinary jurisdiction for the crime that was being imputed to the businessman (the supply of narcotic drugs) and requested “the immediate remission of all the proceedings to the Federal Criminal and Correctional Jurisdiction of the Federal Capital”.
The next step was Judge Galletti’s declaration of incompetence.
“The judges of said seat (referring to the Buenos Aires National Criminal and Correctional Appeals Chamber) in point VI of the ruling on the treatment ‘of the supply of narcotic drugs’, in the last paragraph, have highlighted that: according to this qualification and without prejudice to the bankruptcy degree due to the close connection with the other investigated crimes committed in the same area of space and time, the court must issue an order in relation to the matter of material competence in the summary (article 34 of Law 23,737 “, says the decision of the magistrate.

For the complaint, the result of this new expert opinion could complicate the situation of Sáenz Valiente who last Wednesday, in the ruling of Chamber VI of the Criminal and Correctional Appeals Chamber, ended up being prosecuted, without preventive detention; but with the obligation of having to use an electronic anklet, for the “culpable homicide” and the “facilitation of drugs” to Rodrigues.
Last Tuesday another expert report was also released that detected blood and semen in 25 samples taken from condoms, sheets, padding and even the corset Emmily was wearing the night she died when she fell into the void.
The death of the Brazilian model occurred on March 30, when after having dinner at a restaurant on the Costanera Norte and passing through a bar in Palermo, Emmily (26) arrived at 3:21 a.m. with two friends at the Sáenz Valiente apartment, on the sixth floor of the Libertad 1542 building, in Retiro, where a fourth woman was already.
After an early morning of excesses with the intake of alcohol, marijuana, cocaine and “tuci”, Rodrigues suffered an apparent psychotic break and at 9.18 he ended up falling naked through a window on the sixth floor into the inner courtyard of the building’s block lung, when in the apartment Only Sáenz Valiente and one of her friends remained.
The autopsy concluded that Rodrigues’ death was caused by “polytrauma” and “internal and external bleeding” from the fall and did not detect injuries compatible with a sexual assault.
Sáenz Valiente declared that the young woman suffered a psychotic break and that she threw herself into the void despite the fact that he held her and tried to avoid it.
The businessman was compromised by a series of messages that night with his dealer and with two of the women who went to his house, where he told them that he had “tuci, faso and coca” in his apartment.
