Former President Donald Trump’s lawyer said on Sunday she advises against a plea deal in the classified documents case that led to an indictment.

“I know, I would never advise that, especially if he hasn’t done anything wrong. You’re making a plea to make something go away,” attorney Alina Habba told Fox News on Sunday. “That’s an admission of guilt. He would never plead guilty. Because there was nothing wrong with releasing documents, taking documents with you.’

Special counsel Jack Smith on Friday unsealed the indictment against Trump, which included 37 federal charges, such as willful withholding of national defense information, conspiracy to obstruct justice and false statements. The indictment alleges that Trump not only kept classified documents in his residences, but shared them with others twice in 2021 at Trump National Golf Club in Bedminster, New Jersey.

Trump announced the charges Thursday and said he would plead not guilty.

“This is the most corrupt administration in history — there has never been a government this corrupt before, and they are just now starting to discover it,” Trump told Fox News Digital on Thursday. “They’re trying to deflect all their dishonesty by bringing this ridiculous Box Hoax case.”

Habba said Trump has a “strong defense” because as president he had the power to release documents. She noted that President Biden did not have this authority with regard to classified documents found in his residences from his time as vice president.

“An indictment is a one-sided document,” Habba told Fox News on Sunday. “He has a defense — the defense is real. He had the Presidential Records Act, which only he has in play. Hillary Clinton didn’t have it. Biden didn’t have it. And we’ll put up that defense.”
