Almost three months have passed since Emmily Rodrigues Santos Gomes (26) fell from the sixth floor of the Retiro apartment. The agricultural businessman, Francisco Sáenz Valiente (52), spent a week in detention and was later released for lack of merit.

The lawyers representing the family of the young Brazilian seek to open her cell phone with the Universal Forensic Extraction Device (UFED) from the Cellebrite company, the same one they used to open Natacha Jaitt’s iPad.

New evidence could emerge from that telephone number to help clarify what happened on the morning of March 30 in the apartment at 1500 Libertad Street. In this way, they intend to find previous messages between the victim and Sáenz Valiente, or some exchange with Juliana Magalhaes Murao (37 ), the friend who took her to that place the day of the event, or any request for help prior to death.

The UFED is a new technology incorporated by the National Gendarmerie that allows opening cell phones. Emmily had an iPhone 14 and they have not been able to access the information on his phone after his death. That is why it is not clear if Sáenz Valiente and she had spoken before or if they met that morning as the businessman declared.

Nor if she knew where Juliana Magalhaes Mourao invited her. On her cell phone it could be stated that there was an exchange of money to access the meeting in the apartment, which would involve the doctor in another crime, which at the moment she has evaded but which seems to be an open secret: promotion and facilitation of prostitution . Or if Emmily was tricked into that place at the invitation of whom her friend believed, as denounced by her environment.

They are also looking for possible requests for help or deleted messages that make it possible to clarify the moments before death and determine if he was the victim of a femicide or if, as the businessman says, he threw himself into the void after consuming too many drugs.

In parallel, while the investigation progresses, prosecutors Santiago Vismara, from the Criminal and Correctional Prosecutor’s Office No. 10, and Mariela Labozzetta, from the Specialized Prosecutor Unit for Violence against Women (UFEM), await the result of “key” expert ” to continue the investigation.

Among them, according to sources with access to the file consulted by Clarín, are the expertise on “a syringe with liquid” found in the apartment. “They found three, all empty, without the needle, only with the plastic. One contained liquid and is being analyzed,” they explained.

In addition, they are waiting for the results of the tests on the bedding and the witnesses to the event to be confirmed. Those kidnapped elements from the scene could determine if there was sexual relations at that “party”, if the crime could be linked to the cover-up of sexual abuse as the complaint maintains or if, as the businessman stated, that morning they used drugs, drank alcohol and they danced, until Emmily Rodrigues “had a psychotic break and threw herself out of the window”.

Emmily Rodrígues Santos Gómes (26) died on March 30 when she fell from a sixth floor. Francisco Sáenz Valiente (52), an agricultural businessman, is being held for “aggravated homicide.”

Prosecutors Vismara and Labozzeta appealed to the judge’s decision that issued the lack of merit that released the owner of the apartment and asked that Sáenz Valiente be prosecuted and re-arrested for “femicide and drug facilitation.”

The members of Room 6 of the Chamber toured the department and carried out a visual inspection in the Libertad building at 1500. And a week later, in the hearing with Cassation, Vismara and Labozzeta requested the preventive detention of the accused but this time “for abandonment of person followed by death” and “facilitation of narcotics”.

Ignacio Trimarco, the lawyer for the lawsuit, strongly questioned that decision and asked for prosecution for “femicide” and the supply of drugs. In addition, he added the possible crime of “homicide criminis causa”, arguing that Sáenz Valiente killed Emmily to hide an alleged sexual assault.

Hence, the results of the expertise are decisive for the investigation to advance, especially in this line.

According to the hypothesis of the family of the deceased young woman, Emmily went to that apartment invited by Juliana Mourao, they provided her with drugs and alcohol, and when Dafne Santana (also invited by Juliana) and Lía Alves (invited by Sáenz Valiente in exchange for 10,000 pesos) left the place, the young woman was forced to perform some sexual practice and, when she refused, she began to ask for help through the windows until they finally threw her into the void.

The fact

On the night of Wednesday, March 29, Emmily went to dinner at the Gardiner restaurant on the Costanera Norte with the Brazilian doctor Juliana Magalhaes Mourao and Dafne Santana. From there she went to the Isabel bar, in Palermo, and finally at dawn on Thursday the 30th she went to the apartment of Sáenz Valiente in Retiro.

After a night of excesses, the woman would have suffered a nervous breakdown (according to the version of the businessman and the woman who accompanied him) and at 9.18 he ended up falling naked out of the window.

“She is like possessed,” the businessman had indicated in two calls to 911 that he made prior to the death of the young woman while desperate screams were heard in the background.

The businessman made two calls to 911 and in the second, with the phone open, the moment immediately after the fall was heard.

Sáenz Valiente had time to delete the messages from his cell phone, which were later recovered. There it was found that he bought large amounts of “tuci”, marijuana and cocaine before his guests arrived.

Also, according to the complaint, the department’s security cameras were missing and there were two access doors to the property that were not sealed by the investigators.
