Claudio Paul Caniggia was prosecuted this Monday without preventive detention for the crime of aggravated sexual abuse in the case in which he was denounced by his ex-wife, Mariana Nannis. In addition, Justice issued an embargo on the ex-soccer player’s assets for five million pesos.

The ruling also establishes that Caniggia “must refrain from maintaining any kind of contact with the complainant, Mariana Belén Solange Nannis Silles, be it personal, telephone, text messages, social networks, emails or WhatsApp, instant messengers or an intermediary person.”

In addition, he will have to “inform and prove, more than five business days in advance, when he will leave the national territory of the Argentine Republic, expressly indicating the destination to which he will go and the time that he will remain present in foreign territory.”

Regarding the embargo for five million pesos, it establishes that this “amount must be deposited in Banco Ciudad at the disposal of this judicial headquarters within the term of three days of notification of this order, under penalty of issuing the general inhibition of assets of the person named in case of unjustified non-compliance with the precautionary measure”.

Mariana Nannis’ complaint against Claudio Caniggia

Nannis’s complaint reached the prosecutor’s office of Dr. Carlos Velarde in February 2020, and after months of investigation it was determined that on May 5, 2018, between dawn and the early hours of the morning, Caniggia “tried to have sexual relations with his then wife, Mariana Belén Nannis Silles, but when she refused, he threatened to kill her with insults.”

The event occurred after both withdrew from a wedding party held at the Palermo Hippodrome. From there they went to the “called ‘Residencias del Hotel Faena’, at 450 Petrona Eyle Street, Department 221, in the Autonomous City of Buenos Aires.”

According to the file, Caniggia tried to have sexual relations with who was then his wife, Mariana Belén Solange Nannis Silles, and, when she refused, he threatened her with death.

Then “he punched her in the face that did not hit her, since she was covering herself with her hands, until finally he hit her in the arms and in the aforementioned hands,” according to Nannis’ account, who assured that after the assault was sexually abused.

According to the resolution, “the complainant also described different aspects of violence that occurred in foreign territory that affected her and the couple’s children, as well as some aspects of family privacy.”

In March of last year, the same court had ruled that Caniggia had no merit in the case in which he was denounced for the rape.

According to the resolution ordered by Judge Pablo Ormaechea, at that time there was not enough evidence to make a decision in the case and he asked the prosecutor to continue investigating.
