Christine Baumgartner, the estranged wife of American actor Kevin Costner, has been caught by the paparazzi still in the couple’s $145 million coastal villa in California, amid divorce proceedings and an eviction order from Costner’s lawyers.

The 68-year-old Oscar-winning actor says that under the terms of their prenuptial agreement, Baumgartner, 49, had 30 days to leave the house from the March 1 divorce filing, Radar Network, which has the legal documents, reported.

The actor of the popular film “Dances with Wolves” told the court that Baumgartner’s wife is forcibly staying at home to convince him to accept her financial demands for the separation.

Costner says he has agreed to pay Baumgartner $1.45 million under the prenuptial agreement so his wife can find a suitable place to live, but that doesn’t seem to be enough for him.

Baumgartner, who previously worked as a model and designer of bags, was seen with her mobile phone in her hand as she entered a bank yesterday, writes the Daily Mail.

She was driving a gray Range Rover and was followed by paparazzi from the bank to the Carpinteria complex in California.

Baumgartner has three children with Costner – sons Cayden, 16, and Hayes, 14, and daughter Grace, 13.

Costner has said that under the agreement he will continue to pay child support of $30,000 a month and give his wife a $10,000 advance for living expenses.

He adds in the documents that he is the owner of only three of the family’s homes, and according to the prenuptial agreement signed in 2004, Baumgartner should have left with her possessions in the event of a divorce.

Their Carpinteria complex, on the California coast is estimated to be worth $145 million.

It includes about 200 meters of private beach and a baseball field converted by Costner. The house has views of the Santa Barbara Mountains, several islands visible from the shore, and a horse track.

In 2007, he sold two acres of land to a neighbor, and converted the two houses into a single building.
