Mexico’s lawsuit marches against US arms manufacturers

Secretary of State Marcelo Ebrard announced on Friday that the Mexican government will hold an appeals hearing against US arms manufacturers later this month after a federal judge dismissed the case last September.

In August 2021, the government filed a lawsuit against major US arms companies, holding them responsible for the escalating violence in the country. He said drug cartels and criminal organizations in Mexico are using US weapons to terrorize the Mexican population.

Ebrard said the government will hold an oral defense of the case at the Moakley Federal Courthouse in Massachusetts, USA.

Ebrard tweeted, “The appeal hearing of the lawsuit against the US arms industry will take place on July 24. Fewer deaths here and fewer guns for violence. Mexico will win because it’s right.”

The government filed an appeal on March 14 against the decision of a US federal district court judge in the American city of Boston, which dismissed the case on September 30.

The Judge said that the Legal Protection of the Arms Trade Act (PLCAA), passed in 2005, gives gun manufacturers immunity for misuse of their products or crimes committed.

Mexico appealed the decision.

“There is a correlation between the negligent practices of companies and the violent arms smuggling in Mexico and other crimes such as human trafficking and drug trafficking, particularly fentanyl,” the statement said.

The gun manufacturers that Mexico has sued are Smith & Wesson, Barrett Firearms, Beretta, Century International, Colt’s Manufacturing, Glock, Sturm, Ruger & Co, and Witmer.
