Supreme Court Chief Justice John Roberts on Friday warned against dissent from liberal justices demonizing the Supreme Court when they disagree with the final decisions.

His scolding came as the Supreme Court delivered a blow to the Biden administration’s student loan forgiveness plan — which would have wiped out more than $400 billion in student loan debt — and ruled that it was not allowed by federal law.

Robert’s warned that it is “important that the public is not misled” about the decision in light of how liberal judges are resisting it.

“It has become a disturbing feature of some recent opinion to criticize the decisions with which they disagree as going beyond the proper role of the judiciary,” Roberts wrote. He said the majority reached its decision by adhering to the court’s “old and new” precedent that “requires Congress to speak clearly before a secretary of the Department can unilaterally change large parts of the U.S. economy.”

“We have used the traditional instruments of judicial decision-making. Reasonable minds may disagree with our analysis — in fact, there are at least three,” Roberts wrote, referring to Justices Sonia Sotomayor, Ketanji Brown Jackson and Elena Kagan, who wrote the dissenting opinion.

“We don’t confuse this genuinely sincere disagreement with contempt,” Roberts said.

“It is important that the public is not misled either. Such a misconception would be detrimental to this institution and our country,” he added.

Roberts wrote that after Kagan argued in her dissenting opinion that the majority in its decision “exceeded the permissible limits of the judicial role”.

“From the first page to the last, today’s opinion diverges from the demands of judicial restraint,” Kagan wrote.

“In saying this, and saying this so forcefully, I am not at all belittling those who disagree,” she wrote. The majority is right to make that point, as well as to say that ‘reasonable minds’ can be found on both sides of this matter.

Roberts’ comments come as Democrats on Capitol Hill are questioning the “legitimacy” of the court given its healthy conservative majority. Senate Majority Leader Chuck Schumer, DN.Y., issued a lengthy statement Friday embracing just that.

“After a decades-long, special interest-funded effort to reshape the federal judiciary, the fanatical MAGA right has conquered the Supreme Court and achieved dangerous, regressive policies that they could never achieve at the ballot box,” Schumer said. .

Schumer went on to say that “baseless and disappointing Supreme Court decisions are a stark reminder that it will take a sustained effort to rebalance our federal courts and restore the values ​​that make the United States a beacon for freedom, democracy , equality and opportunity.”
