The Oral Criminal Court (TOC) 28 of Buenos Aires has acquitted the psychiatrist of the man who stabbed federal police officer Juan Pablo Roldán to death three years ago during a psychotic break in front of the Malba Museum in Palermo.

The decision of Judge Carlos Rengel Mirat fell on the doctor Jorge Alberto Monforte (71), guilty of the crimes of “abandonment of a person followed by death”, of the death of his patient Rodrigo Roza and of “murder” of the police officer Roldán.

“My son is seven years old, I have to look him in the face and tell him that I could not find justice for his father’s death,” Roldán’s widow Carolina Zambrano said after the verdict was announced. The courtroom cried before hearings, while one person in the audience cried, “This is justice, they have left an orphaned son.”

The defendant faced two requests for conviction from the accusing parties: on the one hand, prosecutor Sandro Abraldes had requested three years in prison and eight years of disqualification, holding him solely responsible for the death of the police officer; While the lawsuit filed by Roldán’s widow, led by the lawyer Ana Laura Palmucci, asked for a prison sentence of 10 years and another 10 years of disqualification, since the psychiatrist was responsible for the death of the money and also for the death of his patient, Rodrigo Roza.

However, his defense attorney Vadim Mischanchuk – the same one who defended psychiatrist Agustina Cosachov in the death of Diego Maradona – called for his client’s acquittal.

The widow’s lawyers, who represent her as plaintiff, said they will appeal the verdict once they have access to the reasons for the verdict on October 3.

Judge Rengel Mirat is the same who, in February 2021, sentenced the interviewed plastic surgeon Aníbal Lotocki to four years in prison and five years of professional ban in a judgment that has not yet become final for the “serious injuries” to four patients, including the late model Silvina Luna.

What was the psychiatrist accused of?

When the prosecutor who investigated the case, María Paula Asaro, brought the case to court, she attributed Monforte to having acted “negligently and in disregard” of his duties as a psychiatrist in relation to him between September 18 and September 28, 2020 Patient. , whom he had looked after since 2014 and who was diagnosed with “persistent paranoid schizophrenic disorder”.

The allegation was that the psychiatrist ignored “the urgent, necessary and appropriate controls that the above-mentioned patient required”, did not control the medications he administered and did not order an immediate examination for possible hospitalization even in the face of a series of warnings that the Family members communicated their concerns to the professional in the days before the event.

For the prosecution, all this meant “an increase in risk beyond the permissible level, which meant that the patient under his care – Rodrigo Facundo Roza – was abandoned to his fate, leaving him in a situation of helplessness and lack of protection , so he was no longer able to protect him led to his death.

According to the indictment, Roza posed an “imminent danger to himself and third parties” at the time, and Monforte “had the power to prevent that outcome and ignored all positive measures intended to neutralize or reduce it.”

However, the judgment of TOC 28 of Buenos Aires did not take these allegations into account and acquitted the professional.

Roldán, 33 years old and father of four children, was murdered on September 28, 2020 at around 4:30 p.m. on the corner of San Martín de Tours Street and Avenida Figueroa Alcorta, a few meters from the Museum of Latin American Art in Buenos Aires. The PFA member was buried with honors at Chacarita Cemetery and was postmortem promoted by the Ministry of Security from the rank of inspector to director.
